Terms and Conditions (T&C) of the online shop montcalia.ch – AJSK GmbH

1. Scope of application

These Terms and Conditions (T&C) govern the contractual relationship between AJSK GmbH (hereinafter “montcalia.ch”, “Montcalia®” or “AJSK GmbH”) and customers placing orders via the online shop montcalia.ch.

Customer terms that deviate from these T&C are not accepted unless expressly confirmed in writing by montcalia.ch. In the event of discrepancies, the German version of these T&C shall prevail.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.

By clicking “Buy”, the customer submits a binding offer to purchase the items in the shopping cart. The contract is concluded when montcalia.ch confirms the order or when the goods are shipped.

3. Prices, payment and fees

3.1 General

All prices are displayed in Swiss francs (CHF) and include applicable Swiss VAT. Shipping costs are listed separately during the checkout process.

montcalia.ch may adjust prices at any time. The price shown at checkout is binding.

3.2 Payment methods

Accepted payment methods include:

  • Credit and debit cards
  • PayPal
  • Twint
  • Bank transfer (prepayment)
  • Purchase on invoice (via POWERPAY, subject to credit check)
  • Cryptocurrencies (if available)

montcalia.ch may exclude or limit payment methods without providing justification.

3.3 Dynamic pricing and discounts

montcalia.ch uses a dynamic pricing system. Prices and discounts may change at any time based on demand, stock levels, promotions, supplier pricing, or automated price rules.

The price displayed during checkout is binding. Subsequent price changes do not entitle customers to refunds or adjustments.

3.4 Purchase on invoice with instalment option (POWERPAY)

The invoice purchase option is provided by MF Group / POWERPAY. By choosing this method, customers accept the Terms and Conditions of POWERPAY in addition to these T&C.

POWERPAY takes over the claim and manages the payment process. POWERPAY may offer instalment payment options according to its own terms and conditions.

3.5 Credit checks, reminders and collection (POWERPAY)

POWERPAY may perform a credit check. montcalia.ch has no influence over the criteria or the outcome. The decision to grant invoice purchase lies exclusively with POWERPAY.

Reminders, interest charges, collection fees and other related costs are applied solely in accordance with the POWERPAY T&C. montcalia.ch has no influence over these fees.

3.6 Fees for cash payments at the post office counter

Cash payments made at Swiss Post counters usually incur additional fees. These fees must be borne entirely by the customer and may not be deducted from the invoice amount.

If such fees are deducted, the invoice shall be considered unpaid until the full amount is received.

4. International orders and customer responsibility

Customers are solely responsible for checking whether the ordered products — especially dietary supplements, food items, cosmetics, botanical products or health-related items — are legally permitted in the destination country.

montcalia.ch assumes no responsibility for the legality of products outside Switzerland, including:

  • seizures by customs or health authorities,
  • delays due to regulatory inspections,
  • additional import duties, taxes or charges,
  • damage or spoilage resulting from customs delays.

No refund of the purchase price or shipping costs will be granted in such cases.

5. Delivery and shipping

Delivery is made to the address provided by the customer. Delivery times vary depending on the product, warehouse location and destination country.

If a shipment cannot be delivered due to incorrect address, non-collection or refusal of delivery, the customer is responsible for return shipping costs and any costs of resending the package.

For international returns, montcalia.ch may charge a flat-rate fee comparable to a national Swiss shipping cost.

Risk of loss or accidental damage transfers to the customer upon delivery.

6. Return policy

montcalia.ch grants a voluntary return period of 14 days from the date of delivery. Return shipping costs must be borne by the customer.

Returns are accepted only if:

  • products are unused,
  • original packaging is intact and unopened,
  • items are in perfect, resalable condition.

Excluded from return:

  • food and dietary supplements,
  • opened or damaged items,
  • hygiene-related products,
  • customised or made-to-order items.

7. Warranty and liability

Statutory Swiss warranty provisions apply.

montcalia.ch is liable only in cases of intent or gross negligence. Liability for slight negligence is excluded unless essential contractual obligations are affected.

This exclusion does not apply to damages relating to life, bodily integrity or health.

8. Retention of title

Goods remain the property of AJSK GmbH until full payment has been made.

9. Data protection

Personal data is processed in accordance with applicable Swiss data protection law.

10. Final provisions

Swiss law applies exclusively. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Where legally permitted, the place of jurisdiction is the registered office of AJSK GmbH.

Any changes or additions to these T&C must be made in writing.

11. Severability clause

If individual provisions prove invalid or unenforceable, the validity of the remaining provisions remains unaffected. An economically equivalent, legally valid provision will replace the invalid provision.
